Dog’s Ownership: Co-Ownership [ ] Full Ownership [ ]

If a dog is purchased on a co-ownership, the new family does not need to spay or neuter the dog immediately. The dog’s AKC papers will have the family listed as the primary owners of the dog, and Kristen or Megan <EDIT> as the secondary owners. The family must wait until the dog is two years old to consider a breeding. By expense of the dog’s family, the dog will have its hips and elbows x-rayed, the thyroid checked, and the eyes checked. The dog must also have an excellent temperament, showing no aggression. If the dog is lacking in ANY way, part of the monies paid for the dog will be refunded and the dog will be spayed or neutered. If the dog meets the health and temperament requirements of Canterbury Kennels to breed, then any dog being bred with the said dog must also meet the same requirements. If the dog is indeed bred, written consent must be given by Kristen or Megan <EDIT> (whoever is listed as the secondary owner).

If the dog is purchased on a full ownership, the new family does not have to spay or neuter the dog immediately. The dog’s AKC papers will have the family listed as the only owners of the dog. However, a separate contract will keep the said dog from being bred until it has reached the age of two years. As with the co-ownership, all tests will be paid for by the dog’s new family. The dog will have its hips and elbows x-rayed, the thyroid checked, and the eyes checked. The dog must also have an excellent temperament, showing no aggression. If the dog is lacking in ANY way, part of the monies paid for the dog will be refunded and the dog will be spayed or neutered. If the dog meets the health and temperament requirements of Canterbury Kennels to breed, then any dog being bred with the said dog must also meet the same requirements. If the dog is indeed bred, written consent must be given by Kristen or Megan <EDIT>, as required by the separate contact.

If the new family has agreed to spay/neuter the dog, and it is found out that it has been bred (purposefully or accidentally) prior to the sterilization surgery, the new owner agrees to pay the additional sum of $1000.00 for damages to the breed and the breeder. All puppies will become property of Canterbury Kennels (under the ownership of Kristen and Megan <EDIT>Wink. It is also possible that the bred dog will be repossessed and/or altered.

PLEASE BE ADVISED THAT THIS IS A BINDING CONTRACT IN THE UNITED STATES OF AMERICA. FAILURE TO COMPLY WITH ANY OF THE TERMS WILL RESULT IN LEGAL ACTION!!!

The new family is advised to take the Great Dane to their own veterinarian within the first fourteen days of ownership for a general health check-up. At the time of the visit, a stool sample should be taken and a fecal examination conducted. If the dog is of age, it should be tested for heartworm and be put on a preventative. All medical records that have been recorded or received with this dog will be provided at the time of pick up, along with a copy of this contract. Any medical records should be taken to the first veterinary visit so that they may make as accurate of a record as possible.

In consideration with Kristen and Megan <EDIT>, as well as Canterbury Kennels, allowing this family to become the new guardians of this dog as our pet in accordance with all conditions, it is understood that non-compliance with the terms of this contact and falsification of information given within the application or interviews (e-mail, telephone, in person) gives Kristen and Megan <EDIT> the right to reclaim this dog without any refund of money (example: adoption fee, purchase price, and any other monies invested into this dog) from the new family named later within this contract.

Further, the new family agrees that if any terms of this contract are willingly broken, the new family is liable to be sued for breach of contract in the amount, up to, and including $5000.00 or whatever expenses Kristen and Megan <EDIT> incurs in the reclaiming of the said dog; whichever is greater.

OBLIGATIONS OF THE NEW FAMILY TO THE NEW GREAT DANE

1. The dog is to be given a period of up to three months to adjust to its new surroundings, as well as bond and fit in with the new family.
2. This dog is to be returned to Kristen and Megan <EDIT> if it is not able to be kept within any time of the dog’s lifespan. Its transportation will be at the expense of the new family, unless an alternate mode of transportation is approved by Kristen and Megan <EDIT>.
3. This dog is never to be taken to an animal shelter, pound, humane society, rescue, or pet shop. It is also not to be sold or transferred into any new ownership unless written permission is given by Kristen and Megan <EDIT>.
4. This dog is never to be left alone chained or tied up, whether it is inside or outside. The dog may be placed on a trolley system under the supervision of a responsible adult for short periods of time.
5. Within ___ months, the new family shall enroll this dog in a local obedience class, unless otherwise stated by Kristen and Megan <EDIT>.
6. The new family shall never use a choke chain or prong collar on this dog as a training device or regular collar, unless given the specific instruction by Kristen or Megan <EDIT>. If the decision is made, the new family must be shown by a licensed dog trainer on how to use it.
7. The new family shall always give the first consideration to the dog if a conflict arises between it and another animal brought into the home after the ownership of the dog begins.
8. The new family shall maintain the dog on a high quality dog food for the rest of its life. DO NOT FEED REGULAR PUPPY CHOW. Feeding of regular puppy food may cause growth and developmental disorders. This is for the safety and well being of the new dog. Controlled growth and giant breed formulas are acceptable, while large and giant breed foods are ideal. Canterbury Kennels recommends feeding a raw diet, or a top quality kibble. Please remember that you get what you pay for.
9. The dog will be provided with quality veterinary care at all times, including annual vaccinations, parasite control, and dental care.
10. The dog will be tested for heartworm and put on a preventative ALL YEAR LONG.
11. The new family will inform Kristen and Megan <EDIT> of any situation surrounding a decision to euthanize the dog PRIOR to euthanasia, unless the situation is an emergency and the dog is suffering.
12. The new family will inform Kristen and Megan <EDIT> with a veterinary record with a description of the cause of death when the dog has passed away for any reason.
13. The new family will immediately license and mark the dog with personal identification tags on a strong collar.
14. The dog is never to be transported in an open vehicle (pickup truck bed, convertible, etc.) without proper equipment (restrained crate or canine seatbelt).
15. The dog shall always be kept on a leash or long line with a strong collar or harness when the dog is off of the property on which it resides. Exceptions to the rule include enclosed areas and dog parks.
16. If the dog is lost or stolen, Kristen or Megan <EDIT> is to be immediately contacted by telephone. Every effort shall be made to locate the dog. Efforts include, but are not limited to, placing a lost ad in the local and surrounding papers, calling animal control, calling the police, putting up posters, and checking ALL animal shelters, humane societies, and pounds by phone AND in person.
17. The new family will allow Kristen and Megan <EDIT> to periodically check up on the dog by any means needed (phone, in person, e-mail). Kristen and Megan <EDIT> are also given the owners permission to contact and have access to the dog’s veterinarian, trainer, and any other individual involved in the care of the dog. This assures the compliance with all the items in this contract.
18. If Kristen or Megan <EDIT> feels a particular reason or concern that any of the following items in this contract are not being adhered to, the new family agrees to allow Kristen or Megan <EDIT> to come onto the property where the dog is kept to investigate, with or without prior knowledge of the new family. Police investigator, ASPCA representatives, or other animal welfare authorities may be brought if the situation is thought to be bad. Kristen or Megan <EDIT> may reclaim the dog on the spot or ask authorities to take the dog into custody if there is any of the below terms being breached.
A) The dog is never to be used in dog fighting (game or bait), a guard dog, an attack dog, or a protection dog for personal use, any agency, firm, company, or organization.
B) The dog is always to be treated as a house pet. It is not to be kept outdoors for extended periods of time.
C) The dog is always to be treated as a family pet, with affection and kindness. The dog is never to be shown cruelty or abuse.
D) When leaving the dog outdoors temporarily, the new family shall always provide the dog with shelter from the sun and bad weather, a fenced in yard or enclosure, and fresh food and water.
E) The new family will not send the dog away to an obedience class, behaviorist,, or training school without the written consent of Kristen and Megan <EDIT>.
19. Kristen and Megan <EDIT> shall be notified if the new family moves. A new address and telephone number shall be given within three weeks after the move takes place, if not sooner. Kristen and Megan <EDIT> agrees to give the same consideration to the new family of the dog.
20. The new family and Kristen and Megan <EDIT> agree that the actual value of this breed of dog in today’s “market” is approximately $1000.00 or higher, depending on color, structure, and potential of the said dog.
21. The new family agrees to pay a $____.__ fee (adoption fee or sale price) upon receiving the dog. This is refundable (minus the original, non-refundable deposit within the first month of ownership upon return of the dog in the same or better condition with explanation), but at no time thereafter will any monies be refunded.
22. The new family will pay a minimum of a $50.00 handling fee for any and all bounced/NSF checks.
23. The new family will be responsible for any and all legal fees incurred if a violation of this contract results in a legal suit.
24. The new family has read and understands all the information regarding health afflictions and behavior characteristics of this breed.
25. The new family has been advised of all general facts of the breed and of specific conditions for the ownership of this dog. The new family will accept all responsibility for behavior of the dog chosen for ownership.

In consideration with Canterbury Kennels allowing this new family to own this dog as our pet, it is promised that the family agrees to be solely responsible for this animal and to indemnify and hold harmless Kristen and Megan <EDIT> from any claims of liability for the conduct of this dog on or after the date of contract signing. The undersigned further agrees this release and liability and indemnification shall apply to all known, unknown, anticipated, and unanticipated damages resulting from this sale, adoption, control, or lack their of associated with the said dog. This is a binding contract, enforceable by law.

I would 1) spell check =P 2) see if you can find a lawyer friend to look it over to look for loop holes 3) look at puppy contracts from reputable breeders.

I modeled my contract after a mentor of mine who was a very wonderful breeder. We've lost touch.

As for spell-check, it's saying that everything is right, aside for my last name. Did it miss something?

Don't have a lawyer friend, but I do have legally savy friends.
